1. Acceptance
These Terms govern your access to and use of services provided by Pittsburgh Digital Marketing, LLC d/b/a Senior Sentinel ("Senior Sentinel", "we"). By using our website, check‑in service, or portals, you agree to these Terms.
2. Service Overview (Not Emergency or Medical Care)
Senior Sentinel is a scheduled check‑in and notification service. We place automated or agent‑assisted calls and/or SMS to a designated senior and notify the responsible party (RP) based on responses and configured rules. We are not a medical provider, emergency service, or a substitute for 911. In an emergency, call 911 or local emergency services immediately.
3. Eligibility & Accounts
- You must be 18+ to create an account and pay for services. You represent you have authority to enroll a senior and to consent to be contacted.
- You agree to provide accurate information and keep it updated.
- You are responsible for safeguarding login credentials and any device‑level controls (e.g., call/SMS blocking).
4. Subscriptions, Billing & Trials
- Plans auto‑renew until canceled. You authorize recurring charges to your payment method for subscription fees, taxes, and any one‑time setup fees as described at checkout.
- Trials, promotional pricing, and founders offers are subject to their displayed terms and may convert to standard pricing unless canceled before renewal.
- You may cancel anytime effective at the end of your current billing period. Refunds for partial periods are generally not provided except where required by law.
- We may change prices with prior notice. Continued use after changes take effect constitutes acceptance.
5. Communications & Recording Consent
- You consent to receive automated calls and SMS to the phone numbers you provide for service delivery, including check‑ins and alerts. Message/data rates may apply. For SMS, reply STOP to opt out of non‑essential texts.
- Where allowed by law and with required consents, we may record or transcribe calls for quality, training, and troubleshooting. You represent you have obtained any required consent from the senior and other participants.
6. Acceptable Use
- Do not use the service for unlawful purposes or to provide emergency or medical care.
- No interference, reverse engineering, scraping, rate‑limiting bypass, or unauthorized access.
- No content that is illegal, harmful, harassing, deceptive, or infringing.
7. Intellectual Property
We retain all rights in the service, software, content, and marks. You receive a limited, non‑exclusive, non‑transferable license to use the service during an active subscription. You grant us a royalty‑free license to use feedback to improve the service.
8. Third‑Party Services
We use third‑party providers (e.g., telephony, CRM, analytics, payment processing). Their terms may apply for their components.
9. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON‑INFRINGEMENT. We do not warrant uninterrupted or error‑free operation.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; OR FOR LOST PROFITS, LOST DATA, PERSONAL INJURY, OR PROPERTY DAMAGE; EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ANY CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT PAID BY YOU TO US FOR THE SERVICE IN THE SIX (6) MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY.
11. Indemnification
You will defend, indemnify, and hold harmless Senior Sentinel and its affiliates, officers, employees, and agents from any claims arising out of your use of the service, your violation of these Terms, or your violation of law or third‑party rights.
12. Termination
We may suspend or terminate access for any violation or risk to the service, with notice where practical. Upon termination, your right to use the service ends, but provisions that reasonably should survive will survive.
13. Governing Law & Disputes
These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict of laws. Disputes will be resolved through binding arbitration administered by the AAA on an individual basis, with a small‑claims court option where allowed. You may opt out of arbitration within 30 days of accepting these Terms by emailing [email protected]. Class actions and jury trials are waived to the fullest extent permitted by law.
14. Changes to Terms
We may update these Terms occasionally. Material changes will be posted here or emailed. Continued use after changes become effective means you accept the updated Terms.
